1. Introductory provisions and definitions
1.1. These terms and conditions (the “Terms”) govern legal relationships in the sale of digital content via the website audiovodicak.sk (the “Website”). All contractual relationships are concluded in accordance with the legal order of the Slovak Republic.
1.2. Author and content provider
The operator of the Website and the author of the digital content is a natural person:

(the “Author”). The Author is not an entrepreneur (has no company ID number) and acts as the author of a work within the meaning of Act No. 185/2015 Coll., the Copyright Act.
1.3. Seller (Merchant of Record)
The Buyer’s contractual partner for payment processing, invoicing and tax obligations is:

(hereinafter “Paddle”). Paddle acts as the Merchant of Record (registered reseller), i.e. as an authorised reseller of the Product for the Author. This means the Buyer purchases the Product from Paddle via its services, while the Product is licensed by the Author.
1.4. Buyer
The “Buyer” means any natural or legal person who submits an order via the Website to obtain access to the digital content.
1.5. User
A “User” means any natural or legal person who creates a user account on the Website.
2. Subject of the contract and digital content
2.1. The Website offers digital content – in particular audiobooks intended to help prepare for professional qualification examinations for driving motor vehicles (the “Product”).
2.2. The Product is provided through online access (streaming), via a mobile application, or otherwise digitally through the Website interface.
2.3. The Buyer acknowledges that the Product is intended exclusively for personal, non-commercial use.
3. User account
3.1. Before concluding the purchase contract, each Buyer is required to create a user account through registration. During registration and when ordering access to the digital content, the User must provide all data accurately and truthfully. Data provided by the Buyer in the user account and during the order process are considered correct.
3.2. By registering, the User confirms that they have read the Terms, agree with all provisions, and agree to the collection, processing and use of the provided personal data by the Author for administrative, statistical and marketing purposes in accordance with applicable personal data protection regulations.
3.3. By registering, the User agrees to receive commercial communications sent by the Author to the e-mail address provided during registration. The User may withdraw this consent at any time by e-mail to support@audiovodicak.sk.
3.4. Access to the user account is secured with a username and password. The User must keep confidential the information necessary to access their user account.
3.5. The User acknowledges that the user account may not be available continuously, especially due to necessary maintenance of hardware and software equipment of the Author or third parties.
4. Order and conclusion of the contract
4.1. The purchase contract is concluded between the Buyer and Paddle at the moment the Product is made available. It is governed by the Paddle Checkout Buyer Terms (available at: https://www.paddle.com/legal/checkout-buyer-terms).
4.2. The licence agreement is concluded between the Buyer and the Author and is governed by these Terms.
4.3. By completing the order, the Buyer expresses their consent to these Terms and to Paddle’s terms.
5. Price and payment terms
5.1. The Website displays all information about the works made available, including the prices for access. Prices are final and include value added tax (applied according to the Buyer’s country). Prices remain valid for as long as they are displayed in the Website interface. This provision does not limit the Author’s ability to conclude a licence agreement with the Buyer on individually agreed terms.
5.2. The tax document (invoice) is issued and delivered by Paddle by e-mail. On the bank statement, the payment will be marked as PADDLE.COM or PADDLE.NET.
6. Delivery and withdrawal
6.1. The Product is digital content that is not delivered on a tangible medium. Access to the content is provided immediately after payment via the Paddle payment gateway.
6.2. Loss of the right of withdrawal (digital content)
The Buyer acknowledges that the Product is digital content provided immediately after payment in an online form (streaming/access via the Website).
Under applicable legislation, the consumer has the right to withdraw from the contract within 14 days without giving any reason; however, this does not apply if the provision of digital content started with their explicit consent and they were informed in advance that by giving such consent they lose the right of withdrawal.
During the order process via the Paddle payment gateway, the Buyer explicitly agrees to the provision of digital content before the end of the withdrawal period and acknowledges that they thereby lose the right to withdraw from the contract once the Product has been made available.
7. Complaints and support
7.1. Payment-related complaints:
In case of problems with payment, double charges or non-delivery of the invoice, contact Paddle support via their official website (e.g. https://paddle.com/support) or according to the contact details in the payment confirmation e-mail.
7.2. Content-related complaints:
In case of problems with the audiobook functionality or access, contact the Author at support@audiovodicak.sk. The Author undertakes to resolve justified complaints without undue delay (e.g. by restoring access).
8. Licence terms
8.1. The Buyer obtains a non-exclusive licence to access the digital content for their own needs.
8.2. It is prohibited to copy, distribute, sell or further license the Product; interfere with the content of the work; share access credentials with third parties; play it publicly; or otherwise use it commercially. Breach of these terms may lead to termination of access without compensation.
9. Liability
9.1. The Author is not responsible for the outcome of professional qualification examinations for driving motor vehicles. The audiobook is a supplementary study aid and does not replace the wording of laws or official training.
9.2. The Author is not responsible for technical obstacles on the Buyer’s side (e.g. unstable internet, incompatible browser).
9.3. The Author is not responsible for failures or improper performance of services if caused by third parties (in particular mobile operators, providers of telecommunications services and electricity). This also applies to damage caused by computer viruses and similar software.
9.4. The Author is not responsible for the loss of the Buyer’s username and password, their use by a third party, or any damage caused by such use.
9.5. The Author reserves the right to temporarily disable access to the digital content due to repairs, modernisation, adjustments or maintenance of equipment or software, without prior notice to Buyers.
9.6. For proper functionality of the Website and the application, using the Chrome browser is recommended. The Author is not responsible for errors when using another web browser.
10. Personal data protection
10.1. Personal data necessary for processing the payment are processed by Paddle.
10.2. Personal data necessary to provide access to the Product (e.g. e-mail address) are processed by the Author, as a controller under Article 4(7) of Regulation (EU) 2016/679 (GDPR), solely for the purpose of performing the contract and for the technical administration of user accounts. Data are not provided to other third parties, except where required by law. More detailed information is available in the “Privacy Policy” published on the Website.
11. Final provisions
11.1. These legal relationships are governed by the legal order of the Slovak Republic. Consumers can resolve potential disputes through the ODR system (Online Dispute Resolution) at https://consumer-redress.ec.europa.eu/index_en.
11.2. The Author may amend or supplement these Terms without prior notice to the Buyer. Changes become effective on the day of publication. This does not affect rights and obligations that arose during the effectiveness of the previous version of the Terms.
